Abstract
The bank
transfer transaction carried out by a third party on the bankrupt's current
account, although it may be configured as a delegation of payment, loses
however its autonomy by entering into the current account relationship with the
bank account holder; for this reason it is an act that is both subject to
revocation and subject to the request for ineffectiveness pursuant to art. 44
LF if it occurred after the declaration of bankruptcy; both actions are to be
carried out against the Bank.
