Abstract
The Court of Milan - after examining the modalities of the judicial review that must be carried out on the application for a "composition with creditors” and the application for a "composition with creditors on a going concern basis” - highlights that, despite the fact that in the second case the wording of the norm seems to point to a mere control of legitimacy, the Court must actually still verify that the plan is not manifestly unsuitable for the satisfaction of creditors and for the preservation of corporate value.
