Inerenza ed antieconomicità tra “cortine fumogene” e il faro illuminante della Cassazione
Abstract
The uneconomical nature of expenses has taken
on the most disparate forms in tax matters and a diachronic reading of case law
gives an idea of an involution that starts from a misuse of the matching
principle. Ordinance no. 6368/2021, here examined, carries out a rigorous
analysis, which allows us to bring the matching principle back to its most
authentic function. The result is the confirmation that it cannot be questioned
by relating costs and revenues and, consequently, that uneconomicity is a
notion that is unquestionably extraneous to the judgment of inherence. This,
stopping the recurring attempts by tax offices to bend the matching principle
to uses and purposes that are totally extraneous to it, should contain the
abuse of improper recourse to the notion of uneconomicity.
