Abstract
Court of Aosta, called upon
art. 512 of the Italian Civil Procedure Code.The dispute arised upon the
distribution project of an individual enforcement procedure started by the
"fondiario”creditor, raised by the insolvency administrator of the executed
debtor intervened in the process.The Court after the analytical analysis of the
applicable discipline, has perfomed an overview of costs and expenses of the
various professionals involved in the individual enforcement and bankruptcy
proceedings. In particular, the Court excluded the liquidation of legal
expenses in favor of the bankruptcy procedeeings in the hypothesis in which it
intervened in the enforcement procedure for the
only purpose of obtaining the allocation the residual of the proceeds of
the sale, after the full payment of the "fondiario”creditor. The Court had,
also, confirmed that the enforcement procedure has the power to liquidate the
remuneration of the professional delegate for the sale and of the custodian.
